C-81-053 <br />This document presents the results of the Division's Mid-Term Review of Blue Flame <br />Coal Company's Blue Flame Mine. The mid-term review was conducted to fulfill the <br />requirements of Rule 2.06.2(9), 2.06.3(4), 2.06.5(3), 2.06.7(5), 2.08.3 and <br />3.02.2(41, <br />Rules 2.06.2, 2,06.3, 2,06.5 and 2.06.7, require that experimental practices, <br />mountain top removal variances, variances from AOC, and variances for delay in <br />contemporaneous reclamation requirements in combined surface and underground mining <br />operations be reviewed by the Division where applicable during the f4id-Term <br />Review. None of the special categories listed above apply to operations at the <br />Blue Flame Mine. <br />Rule 2.08,3 requires that the Division conduct a review of each permit issued, <br />prior to its mid-term (2 1/2 years). Based on this review, for good cause shown, <br />the Division may reguire reasonable revision or modification of the permit <br />provisions to ensure compliance with the Act and Regulations. <br />Rule 3.02,2(4) requires that the Division review the amount of the financial <br />warranty and the terms of acceptance of the financial warranty every 2 1/2 vears. <br />Based on this review, for good cause shown, the Division may reouire adjustment of <br />the financial warranty to ensure compliance with the Act and Regulations. <br />This Mid-Term Review consisted of a detailed review of the Blue Flame Mine Permit <br />and Findings document to identify any items that may have been overlooked during <br />the initial review. The Division also reviewed all sub seguent revisions to ensure <br />that all permit commitments and conditions were being followed. Problems and <br />observations from past inspection reports and enforcement actions were also <br />considered. <br />Section I. - Histor <br />Permit No, C-81-053 was issued to Blue Flame Coal Company effective September 1, <br />1987 following submittal of an acceptable reclamation bond on August 27, 1987, The <br />proposed Decision and Findings of Compliance was issued August 1, 1986, No coal <br />extraction has occurred at the site since February of 1988 and the mine has been <br />officially in temporary cessation since December 19, 1988. <br />There were no stipulations attached to the original permit. <br />-1 - <br />
