siding. Fourth, the topsoil replacement boundary on revised Map 4 does not <br />coincide with the same boundary as shown on approved Map 8. Fifth, the currently <br />approved Map 8 shows that the approved topsoil replacement plan is to place <br />topsoil onto the reclaimed railroad siding area. Digitization of the topsoil <br />replacement area of this map shows that the area required to be topsoiled is <br />between 11 and 12 acres. Please examine these concerns and respond. <br />20. Depending on the answers to items 18 and 19, please revise the estimated topsoil <br />replacement depth, if appropriate. <br />Item number 18 has been resolved. However, item number 19 remains to be <br />resolved. <br />21. As part of the permit renewal process, the Division has recalculated the estimated <br />liability cost for reclamation at the Tenor Creek Loadout, pursuant to Rule <br />3.02.2(4). The last reclamation liability cost calculation was performed at the 1996 <br />Midterm Review and amounted to $246,755.00. The estimated reclamation <br />liability cost for this permit renewal is calculated as $237,526.00, a decrease of <br />$9229.00. Attached are the Division's worksheets for the reclamation bond <br />calculations. Please review this material and advise the Division as to whether or <br />not the calculations are acceptable. <br />Terror Creek has agreed to the Division's estimate of the cost of reclamation. The <br />estimated reclamation liability cost for this permit renewal has been calculated to <br />be $237,526.00, a decrease of $9229.00 from the previous reclamation liability <br />cost of $246,755.00. The bond liability will be adjusted when the permit renewal <br />has become final. <br />22. On page 2.05-7R of the permit application, please change the name of the railroad <br />from the Denver and Rio Grande Western Railroad to Union Pacific. <br />The Division has no further concerns. Terror Creek revised page 2.05-7R. <br />23. Please update the discussion on productivity standards, found on the fourth text <br />page of Exhibit 11, Alluvial Valley Floors, to include the success standard <br />discussion that is on page 2.05-14Ra. <br />The Division has no further concerns.
