lls
it's necessary for Dave to enumerate all that in
the notice of violation.
If he finds a notice of violation, I
think he puts down what he sees and what is being
alleged. I don't think we want to get into that
kind of an arena myself. I wouldn't want to put
that burden on those folks that are out there
inspecting because it's already in the statute.
MR. CATTANY: I don't disagree with
that. Okay.
MR. JANOSEC: Any other comments?
MR. MCCULLOH: My problem that I'm
having is after the board was invoked for a
hearing -- was asked for a hearing, then -- maybe
I've got this wrong -- then it was vacated.
MR. CATTANY: Disinvoked.
MR. JANOSEC: That was the procedure.
MR. MCCULLOH: ,And that's that gray area
Mr. Brown was talking about.
MR. ABBOTT: Ron put it well. When they
withdrew, were we disinvoked? If not, then we're
going to have to follow what Mark suggested and go
ahead and have the hearing, but if by the agreement
they agreed to we were disinvoked, there's no
reason to have a hearing.
