My review of the statute and regulations <br />2 regarding subsidence was not -- I did not mean to <br />3 articulate that subsidence was violation, merely <br />4 that it looked -- there was an implication that <br />5 when subsidence causes damage to the surface -- and <br />6 I assume from what I've read that includes to <br />7 houses -- that that would be the violation. <br />8 MR. LONG: Only if it's not repaired. <br />9 Only if it's not repaired. <br />10 MR. HELD: That's good. I'm just -- I <br />11 want that -- I wanted that to be brought up. <br />12 MR. JANOSEC: Members of the board, <br />13 we've heard a lot of discussion, a lot of testimony <br />14 here, been in session here for two and a half hours <br />15 on this. I think the time has come that we need to <br />16 have a decision here whether the division had the <br />17 authority to make the decision to vacate this NOV <br />18 or not. <br />19 MR. HELD: Mr. Chairman? <br />20 MR. JANOSEC: Yes. <br />21 MR. HELD: If you're at the point where <br />22 you are going to essentially close the hearing in <br />23 terms of receiving input from all of us, it might <br />24 be good to make a motion to do that and then you <br />25 can have your deliberations. <br />
