11 <br />1 provision in the statute and the regulations for <br />2 someone who considers themselves to be aggrieved by <br />3 the vacation of a notice of violation to ask the <br />4 board to review that action. <br />5 That is, in our view, a completely <br />6 separate action from the issuance of the notice of <br />7 violation or any review proceeding that might have <br />8 been scheduled t o examine the meri ts of that notice <br />9 of violation. <br />10 In other words, in our view, the notice <br />11 of violation no longer exists. It is subject to <br />12 the board's power to resurrect or reinstate that <br />13 violation in response to this new proceeding that <br />14 Basin has brought for that purpose, but that notice <br />15 of violation as we are standing here and sitting <br />16 here right now does not exist, and there is no <br />17 citizen's complaint before DMG that -- as there was <br />18 when they issued the notice of violation, and the <br />19 only thing that the board can consider, in our <br />20 view, is Basin's claim that the violation was -- <br />21 notice of violation was improperly vacated. <br />22 MR. HELD: So, in your opinion, what <br />23 this proceeding is is that in yours and your <br />24 client's eyes that the vacation of the NOV was <br />25 proper, and now Basin is appealing that asserting <br />
