109 <br />1 courts, subsidence in and of itself is not the <br />2 violation. It's only if it causes damage and the <br />3 damage is not repaired. That's when the violation <br />4 comes into play. It's not in and of itself. <br />5 There's no way you can underground <br />6 mine -- if, in fact, it was a violation to <br />7 subsidence, then this country would not allow <br />8 underground mining. That's just the way it is. <br />9 And then finally I guess I would make <br />10 the argument of whether or not we have to write a <br />11 violation because of subsidence and it goes <br />12 forward. What we're saying at this point is pure <br />13 and simple. Citizen complaint alleging subsidence, <br />14 alleging damage. Court prior to this said it <br />15 happened. The citizen saying it's our testimony it <br />16 is. We have an expert witness. We want to pursue <br />17 this as one of our avenues to pursue. <br />18 On second thought -- I don't know what <br />19 the motivations are. I'm not going to get into <br />20 motivations, but we have them saying to us, We have <br />21 decided and we've elected to pursue it in a court <br />22 of law, which is our right. <br />23 I guess I could make the argument or <br />24 would make the argument that basically what we're <br />25 saying is this does not ignore the violation in any <br />
