NCE is the owner of the surface (and mineral) <br />rights leased by Basin and mined under permit C-81-013. These facilities aze essential to <br />the continued value of assets owned by NCE: <br />1). Portable Office Trailer, formerly located at the Golden Eagle complex and <br />now situated adjacent to the River Ponds. This facility will serve as a sales land <br />management office for NCE's approximately 36,000 acre holdings in Las Animas <br />County. <br />2). The Purgatorie River Water Point of Diversion, River Ponds, and Pumping <br />Station. NCE owns numerous water rights on the Purgatorie River. The State <br />Water Court has approved these facilities as a diversion point for NCE's use of <br />these water rights. Basin Resources used these facilities as an integral part of its <br />coal leases from NCE. With the retention of these diversion structures. NCE <br />will be able to use or lease these water rights for purposes other than mining. <br />
