Long <br />Div~sinn Oner mr <br />This letter is written to obtain information pertinent to the above-referenced Notice of Violation issued to <br />Mountain Coal Company. Your prompt response to the following questions is requested so that we may expedite <br />our investigation of the facts in this matter. <br />l) Bear Coal Company has documented certain observations regarding water inflows to the B-Seam in the <br />Bear No. 3 Mine. The letter from J.E. Stover dated October 10, 1997 and the letter from Dan Bear dated <br />December 19, 1997 seem to present conFlicting information. <br />The October ]0, 1997 letter (response number 3) and the December 19, 1997 letter (response number 29) <br />state that inflows were observed during 1994. However, the October 10, 1997 letter (response number I ) <br />indicates that the inflows were noticed during June of 1995. Please clarify this discrepancy. <br />2) Please describe, in detail, the nature of flows observed in the 3rd West Section of the Bear Mine. You <br />have indicated that you observed the flows coming from a "mud line" in the rib. Provide a detailed <br />description of the physical locations and nature of the flow. Specify whether the Flows occurred from the <br />north, south, east, or west rib, and/or from the roof or floor. Please describe how the Flows were first <br />observed, and how Flow estimates were obtained. <br />3) Are you certain that the area of inflow at the 3rd west section was not Flowing any water or producing <br />any moisture for a significant period of time beginning in 1993 when the area was first mined. If so, <br />please describe how you can be certain that the area was initially dry. How much time passed from intial <br />3rd west section development, to the time of your initial observation of water flow from the mine <br />section? <br />4) Prior to the inflows now documented in the 3rd west section, did any Bear Coal Company personnel <br />observe any mine inflows, puddle areas or any other signs of inflow or moisture anywhere in the B or C <br />seam mine areas of the Bear No. 3 Mine? If so, please describe the areas and observations. Did any <br />areas of the Bear No. 3 Mine accumulate any water prior to the observed flows in the 3rd West Section'? <br />If so, describe the location and amounts of any water accumulations. <br />
