s <br />Therefore in consideration of the mutual premises contained herein and for other <br />good and valuable consideration, the receipt and sufficiency of which are hereby <br />acknowledged by each of the parties, it is hereby agreed: <br />Subject to the entry into of a lease agreement with Getty, Chevron hereby <br />agrees and assumes sole liability, subject to the exceptions herein, to <br />undertake those reclamation measures required by the reclamation plan on file <br />with the Board. The area of Chevron's reclamation commitment will be <br />limited to the Disturbed Area //I I in Table I of Exhibit C and further limited <br />to the following reclamation procedures: <br />a. Area f/I I (Guard Gate Area). Parking, traffic ccntrol, training entrance <br />facility located in the 5E-44 of SW-94 of Section 31, T75, R97W, of the 6th <br />P.M. Area of 5.00 acres. During the life of the mine, chemical <br />stabilizers and dust palliatives will be applied to prevent erosion and <br />control fugitive dust. This facility has been in existence since 1973. <br />Upon final abandonment, all buildings and structures will be dismantled <br />and removed. The water well will be sealed and plugged. Compacted <br />ground will be ripped. Fertilizer will be added at the same rate as in <br />Area /l 1. Grass and forb seed will be broadcast with the same species <br />and same rate as previously explained far the slopes of Area ,l I . Straw <br />mulch will be applied at 2,000 Ibs/acre and crimped in.. <br />Reclamation will commence within one year of abandonment. <br />b. The guard gate area is on a pre-e:<isting area of disturbance of 8.3 acres. <br />All land, not including the road, being utilized will be reclaimed <br />according to the pproved plan. <br />2. Chevron does not hereby assume any liability for reclamation of any <br />disturbances of land, groundwater or surface water contamination resulting <br />from Occidental's <br />-2- <br />
