iiiiiiiiiiiiiiiiiii ~ ~~~ ~ ~ Jw 999 AGREEMENT This agreement is made this 1st day of January, 1983, by and between Chevron Shale Oil Company, a California Corporation, 1625 Broadway, Suite 2150, Denver, Colorado 80202, hereinafter referred to as "Chevron" and Occidental Oil Shale Inc., hereinafter referred to as "Occidental". WITNESSETH Whereas Occidental was the lessee of property from Getty Oil Company, hereinafter referred To as "Getty" under a lease with an effective date of February 22, 1976, for that certain piece of property lying east of Roan Creek Road at the foot of Loaan Wash Road in Garfield County, Colorado, containing 24.5945 acres more or less, hereinafter referred to as the "leased premises", which is more specifically described in Exhibit A attached hereto and by this reference incorporated herein; and, Whereas the Occidental lease with Getty expired December 31, 1982; and, Whereas during the term of Occidental's lease with Getty, Occidental installed various improvements and facilities on the leased premises which improvements and facilities are listed and attached hereto as Exhibit B, hereinafter referred to as improvements and by this reference incorporated herein; and, Whereas Occidental has filed with the Colorado Mined Land Reclamation Board, hereinafter referred to as "Board", a comprehensive reclamation plan including the leased premises and additional areas owned or controlled by Occidental, a copy of which is attached hereto as Exhibit C hereinafter referred to as "reclamction plan", and by this reference incorporated herein; and Whereas Occidental was assignee from Garrett Reserach and Deve~•>pment of Garfield County Conditional Use permit No. 008, dated September 25, 1974, attached hereto as Exhibit D and by this reference incorporated herein, hereinafter referred to as "conditional use permit", for the entrance relocation and a tank farm; and, Whereas Chevron is desirous of obtaining a lease from Getty for the leased premises.
