<br />addition, the inlet to culvert No. 40 was excavated during the <br />week of January 6th. The few remaining items required to abate <br />step 1 were completed by the January 16th deadline. <br />NOV C-91-30; Abatement Step 1: <br />Abatement step 1 involves submittal of an "approveable <br />revision" [o construct emergency spillways. A revision request <br />(TR-11) was initially submitted to the Division on September 17, <br />1991 and has been through one round of adequacy responses. Work <br />on responses to a second set of adequacy responses continued <br />through to holiday season resulting in submittal of additional <br />response materials on January 8th. EFCI believes that the <br />submittal responses satisfy all requirements of abatement step no. <br />1. <br />NOV C-91-32; Abatement step 1: <br />A revised Air Pollution Emission Notice, cover letter and <br />application fee were submitted to the Department of Health on <br />January 7th in order to achieve compliance with the emissions <br />permit. <br />NOV C-91-33; Abatement steps 1 and 2: <br />The required seeding and mulching of the new topsoil were <br />completed on January 4th and 6th. The additional information <br />requested to abate step 2 was provided on January 14th, thus <br />completeing full abatement of the violation. <br />NOV C-91-35; Abatement step 1: <br />The permitted sediment trap was excavated on January 3rd, <br />preventing untreated run-off to discharge the permit area. <br />In consideration of the above mentioned efforts to achieve <br />rapid compliance of five violations in approximately two weeks, <br />EFCI requests good faith credit consideration where applicable to <br />the subject notices of violation. <br />Please contact me if you need additional information or have <br />any questions on the information provided herein. <br />Sincerely, <br />(,t(O~-~ <br />~ Allen S.
