III. Comments - Compliance <br />Below are comments on the inspection. The comments include discussion of <br />observations rrede during the inspection. Comments also describe any <br />enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />A berm was in place around the explosives magazine pad, which directed <br />water to a culvert in the southwest part of the pad. There are <br />currently no approved designs for those structures. NOV C-93-025 was <br />issued for failure to include descriptions and designs for each <br />existing structure for which there are specific designs required. <br />Outslopes of the pad showed signs of runoff and deposition. Exhibit <br />4.8-1 of the approved permit application appears to include the pad <br />outslopes in the bonded disturbance area, and so it was determined that <br />runoff on this area did not pose a problem. <br />Drainage control for the grizzly pad consists of a berm and ditch which <br />direct runoff to the West Ridge pond. Coal had been placed outside of <br />the drainage control area in the northwest section of the yard. NOV C- <br />93-026 was issued for failure to protect topsoil and vegetation, and <br />for failure to retain sediment within disturbed areas. <br />The conveyor system areas drain to the tipple pond series. No <br />containment or diversion structures were in place. Coal laden runoff <br />was flowing over undisturbed areas to the tipple and loadout yard from <br />Transfer Point A. A large gully (7' deep, 5' wide) had formed at <br />Transfer Point C. Another gully was observed at the conveyor belt <br />adjacent to the first Goat Trail access road switchback. NOV C-93-026 <br />was issued for failure to protect topsoil and vegetation and failure to <br />retain sediment in disturbed areas. <br />The equipment storage yard north of the shop area was inspected and no <br />problems were noted. <br />Topsoil stockpiles observed were stable and vegetated. Topsoil was <br />stripped approximately five pit widths ahead of the Moffat pit, and had <br />been placed in windrows on the north side. Redistribution areas (Fall <br />1992) in the Moffat pit area showed some rilling. The operator should <br />monitor this area and repair the rills prior to seeding. <br />The approved permit application states that surplus topsoil will be <br />redistributed in facilities areas from which topsoil was not salvaged <br />(pre-law construction). The operator and the Division should review <br />topsoil salvage and redistribution balances in the Moffat area to <br />determine the amount of topsoil that will be available for <br />redistribution in the facilities areas. <br />General Mine Plan Compliance - Mining operations were conducted within <br />disturbance boundaries, with the exceptions noted above. Reclamation <br />activities were being conducted contemporaneously. Required stability, <br />water, and rill and gully monitoring is performed. <br />Edna Strip Mine 4 3/30/93 - 4/2/93 <br />
