[II. Comments - Compliance <br />Below are comments on the inspection. The comments include discussion of <br />ooservations made during tfie inspection. Comments also describe any <br />enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />sample will be analyzed at the Colorado Department of Health <br />laboratories. <br />The West Ridge pond contained water but was not discharging. The <br />Center Ridge pond was discharging clear water, at a rate of <br />approximately 100 gpm. The Moffat Pond was discharging clear water at <br />a rate of approximately 150 gpm. There was a considerable amount of <br />water flowing into the pond through dewatering of the Moffat pit. The <br />pond is sized for dewatering the Moffat pit since water in the pit is <br />not groundwater inflow, but is surface water runoff from lands included <br />in the pond watershed. The operator was conducting NPDES sampling on <br />the discharging ponds during the inspection. <br />Berms and ditches designed to protect the hydrologic balance were <br />inspected. NOV C-93-023 was issued for failure to pass disturbed area <br />drainage through a sedimentation pond. The Trout Creek water pump <br />disturbance area had no sedimentation control practices in place. <br />Drainage from the pad was flowing directly to Trout Creek. <br />Backfill and Grading was current (within two spoil ridges of the active <br />pit) in the Moffat area. One dozer was working toward final grade in <br />the West Ridge area. <br />Explosives magazines were in good condition and were secured. No <br />blasts were observed during the inspection. <br />Support Facilities - The office, tipple, and loadout facilities were <br />inspected. Culvert and ditch maintenance items were identified and the <br />work carried out prior to the close of the inspection, with the <br />exception of perimeter marker repairs. No other problems were noted in <br />these areas. <br />The shop buildings and yard were inspected. Surface water runoff was, <br />for the most part, controlled by a berm on the east side, and ditches <br />on the west side. A culvert was in place at the fuel pumps. There is <br />currently no approved design for those structures. NOV C-93-025 was <br />issued for failure to include descriptions and designs of each existing <br />structure for which there are specific designs required. The approved <br />plan shows only a berm on the west side of the coal stockpile. That <br />berm was not constructed as designed, resulting in the issuance of NOV <br />C-93-027, for failure to construct and maintain sediment control <br />structures as designed. Snow removal equipment had pushed coal over <br />the berm on the east side of the shop pad, into an undisturbed area. <br />NOV C-93-026 was issued for failure to provide protection for topsoil <br />and vegetation, and for a failure to retain sediment within disturbed <br />areas. <br />Edna Strip Mine 3 3/30/93 - 4/2/93 <br />
