It would be <br />inappropriate to accept data after abatement of a violation, <br />particularly when the abatement procedures specifically requested <br />as a step to abate the violation that all missing data be provided. <br />If this data were to be accepted, it could only be done under a <br />FTACO, where a penalty of $750.00 per dayt would be assessed from <br />December 10, 1994 to January 6, 1995. The Division requests that <br />the original penalty of $1,250.00 be upheld. <br />If you have questions, please call me. <br />
