According to a company representative, the effluent discharged <br />at outfa2l 001 had the following pollutant characteristics: <br />pH, in Total iron, in <br />Date standard unl[s milligrams per llter (mg/1) <br />Flay 9, 1986 5.8 13.9 <br />Clay 12, 1986 5.2 195 <br />Kay 14, 1986 5.5 -- <br />NOTICE OF VIOLATION <br />You are hereby notified that the facts stated above constitute 5 <br />violations of Part I.A.1 of the permit, as set forth below: <br />1. The pN values of 5.8, 5.2, and 5.5 reported for May 9, ;tay 12, <br />and May 14, 1986, respectively are less than the minimum required by the <br />permit of 6.5 standard units as determined by a single, grab sample. <br />2. The total iron concentration of 13.9 mg/1 on May 9, 1986 and 195 <br />mg/1 on May 12, 1986 exceeds the daily maximum allowed by the permit of 7.0 <br />mg/1 as determined by a single, grab sample. <br />CEASE AND DESIST ORDER <br />Based upon the foregoing findings of Fact and notice of violation, <br />and pursuant to the provisions of 25-8-605, C.R.S. (1982), I hereby order you <br />to: <br />1. immediately take wi~atever measures necessary to cease and desist <br />violating the permit and the Water Quality Control Act, C25-8-101 through 703, <br />C.B.S., 1982 and 1985 supp.) and regulations promulgated thereto; <br />Z. submit to the division, in writing, within 15 days after <br />issuance of this order, a detailed statement of the measures you have taken or <br />plan to take to achieve compliance with paragraph 1 of this order; <br />J. submit to the division, in writing, within 60 days of issuance <br />of this order, a detailed plan outlining how compliance will be maintained in <br />the future in the event that B-seam water is encountered in the active <br />workings of mine Q1; <br />4. submit to the division, in writing, within 10 days of issuance <br />of this order a statement of your intenc to comply herewith. <br />-2- <br />
