COUNTY, COLORADO <br />T0: Suo+.vass Coal Company <br />FIWINGS OF FACT <br />• <br />Pursuant to the authority vested in the Division of Administration of the <br />Colorado Department of Health ("the division") by 25-8-301 to 308, C.R.S. <br />(1982 and 1985 supo.), which authority has been delegated to me by the <br />executive director of the department, I hereby make the following findings of <br />fact: <br />1. Snocmass Coal Company (the company) operates an underground coal <br />mine located approximately 8 miles southwest of Carbondale in Pitkin County, <br />Colorado. <br />2. Mine drainage from the G1 mine is contained in storage tanks and <br />either used as make up water in the coal preparation plant or discharged to <br />North Thompson Creek (the creek). <br />3. Discharge to the creek is authorized under the terms and <br />conditions of Colorado Discharge Permit System permit number CO-0029599 (the <br />pewit} which became effective on October 18, 1982, was amended on August 19, <br />1985, and is scheduled to expire on tlarch 31, 1987. <br />4. The discharge to the creek described in paragraph 2 of these <br />findings is designated in the permit as outfall 001. Outfall 001 is a "point <br />source" as defined by 25-8-103(14), C.R.S. (1982). <br />(1982). <br />5. The creek is "state waters" as defined by 25-8-103(19), C.R.S. <br />6. According to a company representative, on May 6, 1986 water <br />originating i^ some old mine workings (B-seam water) was flowing into the Ill <br />mine at an initial rate of 30 gallons per minute. The company allowed the <br />B-seam water to mix with the 111 mine water and to discharge to the creek ac <br />outfall 001. <br />EXIII6IT A <br />
