for the Extraction of Constmction Materials, Section 34-32.5-101 et seq. C.R.S. (2006) <br />("Act"). The Board found the Operator in violation of Section 34-32.5-116(4)(1) of the Act <br />for failing to protect areas outside of the affected land from slides or damage during <br />mining operations. The Board ordered the Operator to convert the Operator's existing <br />Section 110 permit into a Section 112 permit to include all affected lands within the new <br />permit by July 31, 2006. The Boazd ordered the Operator to post an interim reclamation <br />bond in an amount to be calculated by the Division. The Board assessed civil penalties <br />in the amount of $7,200.00, based on the rate of $100.00 per day for 72 days, with all but <br />$400.00 suspended if the Operator complied with the corrective actions in a timely <br />manner as specified herein. <br />4. The Boazd has jurisdiction over this matter pursuant to Sections 34-32.5-104, 34-32.5-105 <br />and 34-32.5-124 ofthe Act. <br />The Operator obtained additional time to convert its permit from the Boazd during a <br />hearing on July 12, 2006. The Operator again requests additional time to convert its <br />existing Section 110 permit into a Section 112 permit, as required by the Boazd order. The <br />Operator's representative stated that, due to a discrepancy concerning the legal name of the <br />Operator, he needed more time to obtain legal right of entry from the Bureau of Land <br />Management. <br />6. The Division recommends approval of the extension request. <br />Because the Operator has requested an extension to allow additional time to obtain legal <br />right of entry and because the Division agrees that an extension is warranted, it is <br />appropriate for the Board to grant the Operator's extension request. <br />Colorado Quarries, Inc.
