The file number in this matter is <br />M-1987-027. Bill Tezak appeazed by telephone on behalf of Colorado Quarries, Inc. <br />("Operator"). Bob Oswald appeared by telephone on behalf of the Division of Reclamation, <br />Mining and Safety ("Division"). <br />The Board, having considered the parties' presentations and having been otherwise fully <br />informed of the facts in this matter, hereby enters the following findings of fact, conclusions of <br />law and order: <br />The Operator currently possesses an approved Section 110c Reclamation Permit fora 6- <br />acre rhyolite mine located in Section 8, Township 22 South, Range 72 West, 6`h P.M., <br />Custer County, Colorado. <br />2. The Division inspected the site on August 24, 2005 and observed approximately 2.03 acres <br />of mining activity outside the approved permit boundaries. The activity included topsoil <br />stripping, stockpiling, material excavation and hauling. <br />On February 16, 2006, the Board held a duly noticed public hearing to consider the <br />Division's request to find the Operator in violation of the Colorado Land Reclamation Act <br />Colorado Quarries, Inc.
