As you have indicated, Abraxus Company has been <br />issued a Coal Mining and Reclamation permit by the State of <br />Colorado. This permit allows the permittee to extract 200,000 <br />tons of coal per year. <br />The Colorado Surface Coal Mining Reclamation Act and the Colorado <br />Rules for Coal Mining require that an operator be in compliance <br />with applicable local laws. For most coal mining situations, <br />this usually means that the operator must comply with county land <br />use regulations and zoning requirements. The specifics of these <br />local requirements vary from county to county. <br />Once the county permitting issues are resolved, production at the <br />mine may commence. My review of the issues which you have raised <br />leads me to believe that these are local land use issues which <br />are normally resolved at the county level. This Division is not <br />in a position to influence local land use practices or <br />regulations. However, I will forward your letters to the <br />Department of Local Affairs.
