<br />-2- <br />BOARD ORDER <br /> <br />Based on these same findings of fact, and in accordance with C.R.S. 3d-32-124(6) the <br />Colorado Mined Land Reclamation Board hereby issues the following Board Order: <br />The Mined Land Reclamation Board believes that at this point in time the <br />milling/processing portion of the Gold Hill Mill and Hines, Percoit No. M-83-141, <br />cannot be conducted in compliance with the terms and conditions of the Mined Land <br />Reclamation Act. Therefore, Permit H-83-141~ie hereby modified such that the <br />operator ie ordered to commence reclamation on the milling portion of the permit <br />area by July 28, 1995. The Mined Land Reclamation Board believes that the mining <br />portion of the Gold Hill Mill and Mines, Permit No. M-83-141 can be conducted in <br />compliance with the Mined Land Reclamation Act, and therefore the mining portion <br />of the permit will not be modified at this time. if this Board Order ie not <br />complied with by the date specified, Permit H-83-141 will be scheduled for permit <br />revocation and bond forfeiture at the August, 1995 meeting of the Mined Land <br />Reclamation Board. <br />In clarification of the rights of recipients of Board orders, parties are advised to <br />consult the Colorado Mined Land Reclamation Act and the State Administrative Procedure <br />Act. <br />Nothing herein contained, particularly those portions requiring certain acts to be <br />performed within a certain time, shall be construed ae a permit or license to engage in <br />any prospecting or mining operations within the State. <br />Persons concerned with judicial review of the provisions of this order are advised to <br />consult C.R.S. 24-4-106, ae amended. <br />\~ <br />Dated at Denver thie~_ day of ~~N-Il. ,~. <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />MICHAEL B.
