Office of State Engineer <br />Colorado Division of Water Resources <br />June 23, 2003 <br />Page two <br />application to apply the gravel mine on the BLC Development, LLC property, but no Amend <br />Permit application appears to have been filed.) <br />(c) Hall-Irwin Construction Co., in its application for Substitute Supply Plan stated that <br />the maximum exposed ground water would be 3.72 acres. <br />(d) Hall-Irwin, in its application for Substitute Supply Plan stated Booth Land and <br />Livestock Company owned two imgation wells within 600 feet of the proposed gravel pit, which <br />appears to be correct. <br />(e) No Substitute Supply Plan has been approved. <br />(f) No Gravel Pit Well Permit has been granted. <br />(g) Hall-Irwin Construction Co. in an Amended Mining Permit application with the <br />Division of Minerals and Geology stated that the State Engineer's Office had issued a Gravel <br />Permit Well Permit and Mr. Gregg of Hall-hwin Construction Co. apparently represented to <br />Thomas A. Schreiner, an inspector with the Division of Minerals and Geology that Hall-Irwin <br />Construction Company had an approved Well Permit and Temporary Substitute Supply Plan <br />from the State Engineer's Office. <br />Please be advised: <br />1. Contrary to the representations in the application for Substitute Supply Plan, the <br />exposed ground water from the mining operation exceeds an estimated 20 acres. Enclosed is an <br />aerial photograph taken on June 15, 2003 which is scaled to approximately 150 feet equals one <br />inch. The aerial photograph reveals a gravel pit and a wash or settling pond with exposed <br />surface water estimated to be 22 acres. Additionally, in the southwest corner of the property is a <br />sit basin which contains some surface water with an estimated area of 10 acres other mined <br />areas. Other mined areas also contain exposed ground water. <br />2. BLC Development, LLC has not signed a Well Spacing Consent Statement and <br />will not sign a Well Spacing Consent Statement without protective conditions and affirmative <br />covenants from Hall-Irwin Construction Co. <br />3. Hall-Irwin Construction Co. is commencing expanded gravel mining operations <br />exceeding what appears to be the 40 acres of the original Gravel Mind Well Permit, without the <br />authorization and consent of BLC Development, LLC, which is required for expanded mining <br />operations and has exposed additional ground water without applying for an additional Gravel <br />Pit Water Permit application.
