This gravei mine has been operating for at least two years. <br />A search of the permit files in the State Engineer's Office reveals: <br />(a) Hall-Irwin Construction Co. has not applied for a Gravel Pit Well Permit on the BLC <br />Development, LLC property above-described on which gravel mining has continued for at least <br />two years. <br />(b) Hall-Irwin did file a Gravel Pit Well Permit application on July 17, 1998 fora 40 . <br />acre gravel mine, but the location of the gravel mine was described as the NW'/4 of the SW'/<, <br />Section 2, Township 2N, Range 68W of the 6`h P.M., which property is at least % of a mile west <br />of the BLC Development, LLC property (apparently Hall-Irwin Construction Co. intended the <br />
