A substitute water supply plan to replace all water lost to the affected stream
system must be filed with the Colorado Division of Water Resources for each pit.
The filing fee associated with each plan is $1,343.
Please be aware that legal assistance from the Attorney General's Office will be sought
to ensure cornpliance with statutory provision outlined in Senate Bill 120 for all pits operating
without the necessary plans and/or permits.
Review of our files does not show that well permits, substitute water supply plans, or
plans for augmentation have been obtained for these pits. If these items have in fact have been
obtained please respond by providing relevant well permit numbers, receipt numbers, court case
numbers, etc. Otherwise you should respond to this letter by submitting a gravel pit well permit
applications (forms attached) and a substitute water supply plans with the associated filing fees
within 30 days of your receipt of this letter.
Please contact myself or the Division Engineer in Alamosa at (719)589-6683 if you have
any questions.
Sincerely,
KVH:riogrand.wp
18t~1'L` <<ndit /~~'~
Keith Vander Horst
Water Resources Engineer
cc: Steve Vandiver, Water Commissioner
Steve Baer, Water Commissioner
Division of Minerals & Geology
