It also requires that
well permits and substitute water supply plans or Water Court augmentation plans be obtained
for these pits.
As delegated through legislative intent, this office is in the process of determining which
gravel pits expose ground water and which do not. We may have sent you a letter requesting
this information previously, but our records indicate that we have not received a response,
Our office considers a pit to expose ground water if it has water in it for any part of the
year that is not the result of direct surface water diversion into the pit. In addition, if the pit has
to be continually dewatered, we consider it to expose ground water. The Colorado Division of
Minerals and Geology recently provided our oiTice with copies of reports of July 11, 1995 field
inspections of the County's above referenced pits indicating that the above referenced pits do
expose ground water.
If the county claims these gravel pits do not expose ground water, or the exposure
occurred prior to December 31, 1980, please provide documentation of this claim. If the gravel
pits have exposed ground water after December 31, 1980 the county has the following
responsibilities:
A gravel pit well permit application and the associated $60 filing fee must be
submitted to the Colorado Division of Water Resources for each pit.
