III IIIIIIIIIIIII III <br />999 <br />Interoffice <br />MEMORANDUM <br />to: Mike bong <br />from: Kent Gorham <br />subject: CV-2001-016, Lorencito Canyon Mine, #C-96-084 <br />date: December 17, 2001 <br />Please find attached a letter (Exhibit A) requesting vacation of Notice of Violation CV-2001-016 <br />issued to Lorencito Coal Company. The violation was issued for failure to conduct apre-blast <br />survey prior to conducting blasting operations at the Lorencito Canyon Mine. <br />The pre-blast survey was requested by a homeowner via a letter received by the Division on <br />September 25, 2001. This request was successfully FAXed to the Greystone Consultants <br />(Lorencito's representative at that time) on the same day. Also, a letter (Exhibit B) was sent to <br />the landowner indicating [hat Greystone had been notified and that someone would be contacting <br />them in the near future. Greystone was also copied on this letter. <br />The first blast took place on October 19, 2001. The pre-blast survey for the home that is the <br />subject of the NOV was conducted on November 24, 2001. The operator blames internal <br />communication difficulties as the reason the survey was not conducted prior to the initiation of <br />blasting operations. <br />The violation also cited the failure to publish a blasting schedule at least 10 days but not more <br />than 20 days before beginning a blasting program (Rule 4.08.3(1)(a)). The schedule was <br />published September 11, 2001 and the first blast was conducted o tober 19, 2001 (38-day <br />separation). <br />Based on the information supplied by the <br />NOV. <br />the Division does not support vacation of this <br />CC: David Berry <br />Dan Hernandez <br />~ ~-S~ ~-~ <br />S~ <br />~~ <br />
