N.W. <br />Gig Harbor, WA 98335 <br /> <br />AMENDED <br />CEASE AND DESIST <br />ORDER <br />NOTICE OF <br />VIOLATION <br />M-94-003 <br />To: LKA International, Inc., Kye Abraham and all other persons <br />engaged in or owning or controlling the Golden Wonder Mine located <br />in NW NW, Section 10, T43N, R4W, N.M.P.M, in Hinsdale County, <br />Colorado. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined <br />Lend Reclamation Board by C.R.S. 34-32-123, the Board hereby makes <br />the following findings of fact: <br />1. On January 26, 1994 the Board conducted a hearing and found LKA <br />International, Inc. to be conducting mining activities outside of <br />the approved permit area in violation of C.R.S. 34-32-101 et seg. <br />2. On January 26, 1994 the Board issued Notice of Violation end <br />Cease and Desist Order M-94-003 to LKA International, Inc. <br />3. On May 25, 1994 the Board conducted a hearing in accordance <br />with C.R.S. 24-4-101 et seg. to consider a request by LKA <br />International, Inc. to reconsider the corrective action date set in <br />the Cease and Desist Order issued on January 26, 1994. <br />4. Evidence was presented during the hearing on May 25, 1994 that <br />a permit amendment, satisfying the corrective action specified in <br />the Cease end Desist Order issued January 26, 1994, had been <br />submitted to the Division but its approval could not be expected by <br />the required corrective action date of April 26, 1994. <br />
