Walther <br />EnecWive Dueaor <br />Michael B. Lons <br />Division Onecwr <br />The Division has approved your application for Technical Revision No. 3 (TR-003) to Permit No. <br />M-91-146. The revision addresses removal of the plans for Phase II mining at this site and the <br />addition of a stockpile area. As you requested, the proposal to include a wash plant facility has <br />been deleted from this revision application. <br />The approval is based on the revision application material and your responses to DMG's adequacy <br />review. As we discussed in our phone conversation on this date, the amount of material to be <br />removed and replaced at the central berm breach location is based on a 20 foot wide cut in a <br />berm that is 8 feet high, with a 20 foot wide base and a 4 foot wide top. The volume is 71 cubic <br />yards of material. <br />DMG feels the reclamation requirement to plant 24 - 6 foot to 10 foot cottonwoods, to replace <br />vegetation disturbed by mining, is a minimal requirement that will help stabilize the site after <br />mining ceases. Therefore, this requirement has not been removed from the reclamation plan. <br />The reclamation cost estimate (enclosed) for this operation has been recalculated, based on the <br />reclamation requirements that have been revised by TR-003. As you can see, the site is currently <br />over-honded. ZMK will need to submit a new financial warranty in the amount indicated on the <br />enclosed estimate. Upon receipt and acceptance of the new financial warranty, the warranty <br />currently held by the state will be returned to you.
