15. In her letter of May 9, 1995, Ms. Ann Tatum noted that
another inspection of the Tatum home by DMG and OSM experts was
scheduled for May 11, 1995. Also to be present at the inspection
were experts for Basin Resources and the Tatums. Specifically
mentioned by Ms. tatum as expected for the inspection were:
Michael Rosenthal - OSM
Dr. Kewal Kohli - OSM
Jim Pendleton - DMG
Randy Price - DMG
Larry Bennett - Basin Resources
Ralph Lopez - Basin Resources
Carl Gerity - Pioneer Engineering (Tatum expert)
See AR II-22. As confirmed by Ms. Ann Tatum in her letter of May
12, 1995, the inspection occurred as scheduled. See AR II-20.
16. In a memorandum dated May 22, 1995, DMG employee Jim
Pendleton provided his observations concerning the May 11, 1995,
inspection of the Tatum home. (In the memorandum, Mr. Pendleton
inadvertently refers to the inspection as having occurred on May
5, 1995). Although he provides no new conclusions concerning the
effect, or lack of effect, of subsidence on the house, Mr.
Pendleton does provide comments on the negative effect heavy rain
was having on the adobe house's structure. In addition, on page
2 of his memorandum, Mr. Pendleton discusses a deteriorating
portion of the porch area of the home. Concerning this area, Mr.
Pendleton states that
[t]he adobe wall appears to be deteriorating solely
because of the affects of water which has invaded the
adobe wall structure and percolated down two stories to
the bottom of the inner porch wall.
See AR II-16.
9
