C-85-045, Mine No. 3, Permit C-84-062 <br />Dear Mr. Mathews: <br />Colorado Yampa Coal Company (CYCC) is submitting the following informa- <br />tion concerning the above referenced alleged violation which was issued to <br />CYCC on May 24, 1985. The alleged violation was issued for "failure to con- <br />struct sediment control facilities in compliance with approved design. Speci- <br />fically, collection ditch P-1 along base of Middle Creek pit rough graded <br />spoils has not been constructed and required dewatering device has not been <br />installed in the Middle Creek Detention Basin." <br />In light of the immediate review and cursory engineering designs recently <br />conducted, it is evident that the presently approved sediment control facili- <br />ties, ditch P-1 and the Middle Creek Detention Basin is not a practical long- <br />term solution to the sediment control issue at the Middle Creek Pit area. <br />CYCC requests that the abatement date of alleged violation C-85-045 be <br />extended from June 20, 1985 to August 22, 1985. Justification for such re- <br />quest is as follows: <br />1. The entire Middle Creek Pit area needs to be surveyed to establish <br />present topography. <br />2. New engineering designs need to be developed for a new sediment <br />control plan for the area. <br />3. The new sediment control plan needs to be submitted to and approved <br />by CMLRD prior to implementation. <br />4. Evaluations of modified primary dewatering devises need to be con- <br />ducted. <br />5. New engineering designs associated with the primary dewatering de- <br />vise needs to be completed. <br />6. The new engineering designs associated with the primary dewatering <br />devise needs to submitted to and approved by CMLRD prior to imple- <br />mentation. <br />
