Should more than 10% ol'the pit slopes in azeas <br />proposed for extraction exceed 2:1, an additional bond may be assessed to account for <br />the additional volume of material that would need to he moved at closure. Other <br />factors may also contribute to an increased bond amount. Conversely, the <br />Superintendent may recommend a reduction of the bond if a portion of the site has <br />been reclaimed to the standazds outlined in the reclamation plan. <br />Unless a subsequent Plan of Operations is submitted For review, reclamation activities <br />shall commence no later than six (ti) months after conclusion of mining operations <br />detined in the existing Plan of Operations and shall be completed within two (2) years <br />of commencement. The operator's and surety's responsibility and liability shall <br />continue under the performance bond or security deposit until the Superintendent <br />determines that the operator has complied with all terms and conditions of the Plan of <br />Operations and has successfully reclaimed the area of operations. When all <br />reclamation requirements of the Plan of Operations aze completed, the Superintendent <br />will notify the operator in writing that the term of liability under the bond or security <br />deposit has concluded. <br />23. This permit is issued subject to valid existing rights including those of any persons <br />who may have valid interests in the subject lands as of the date of this permi[. Upon <br />acceptance of this permit, the permittee accepts all responsibility for damage to <br />holders of valid existing rights that may occur from actions taken under this permit. <br />24. The permittee agrees to indemnify and hold harmless the United States from any loss <br />to it, including not only damage to Government property and injury to (;ovemment <br />employees, but also judgment, settlements, or compromises for property damage, <br />illness or injury to all persons for which the United States may be liable resulting <br />From [he exercise of the permittee and its employees of the privileges granted. <br />
