See also Rules 2.04.7(1)(b) and 2.04.7(4). A complete list of wells was not found in the <br />PAP. A description of wells (State Engineers Records) located in the Sections about the <br />permit area is provided under separate cover. Please expand this portion of the PAP <br />to comply with these rules. <br />Response: HGTI reviewed the groundwater well list that accompanied the Division's Mid-Term <br />Permit Review. This list, as well as, additional data from the State Engineers office was used to <br />developed a list of groundwater wells in the vicinity of the permit area to be included in the PAP to <br />satisfy the intent of Rules 2.04.7(1)(b) and 2.04.7(4). The "new" groundwater well list should be <br />inserted into the PAP as Appendix 7-3, Groundwater Wells in the Vicinity of the Permit Area. <br />Rule 2.04.7(4)(a) <br />Item 8. No map of well locations, at a minimum scale of 1:24, 000 in conformance with Rule <br />2.10, was found in the PAP. Please add such a map to the PAP. <br />Response: HGTI has prepared a map showing the locations of groundwater wells in the vicinity of <br />the Hayden Gulch Loadout. Exhibit 7-1, Groundwater Wells in the Vicinity of the Loadout Permit <br />Area, should be inserted into the permit application package in accordance with the accompanying <br />insertion instructions. <br />Item 9. All the wells within a mile have not been identified. Please identify, in the PAP, all <br />wells within, and within a mile of, the permit area. <br />Response: Please see HGTI's responses to Items No. 8 and 9, above. <br />The permit is in temporary cessation. TR-6 approved certain changes to existing features of the <br />permit area. However, due to temporary cessation, these approved features have not materialized. <br />Not only does this situation provide a confusing representation of the permit area, but leaves (after <br />posting of TR-ti changes to the PAP) some existing features without authorization or required <br />supporting information. For example, haul roads, access roads, drainage ditches, and structures <br />are in a state of flux. Some of the following comments are derived as a result of this incomplete <br />transition from existing fo approved conditions. <br />Item 10. Please clam the PAP to describe existing and approved conditions, with supporting <br />documentation for each. Retention of Drawings 12-1, Revision 10; 12-IA, Revision 0 <br />of 5/1 S/00, and 12-2, Revision 7; and supporting documentation (haul and access road <br />certifications, ditch designs, etc.), with text that explains the transition over a period of <br />temporary cessation might clam the difference between the maps and text in the PAP <br />and the conditions presently at the site. See Items 11 through 17. <br />Response: To help reduce the perceived confusion regarding the 2 MM ton/year coal handling <br />system approved by TR-06 and what is currently existing and on the ground, HGTI has revised Tab <br />12 to include discussions and information that describe both what is approved by TR-06, and what is <br />currently existing and on the ground. <br />Hydro-Environmental Solutions, Inc. <br />P.O.
