MANAGEMENT <br />On behalf of Bowie Resources, LLC,"BRL" enclosed is an application for a permit <br />revision to provide for an amended longwall mine plan in the B-Seam. BRL was able to <br />squeeze in a third west panel by moving the 1 West Mains to the north. The 1 North <br />Mains were rotated to the west to enhance resource recovery. Both the 1 West Mains <br />and the 1 North Mains encroach on unleased Federal coal so an application for a <br />Federal Coal Lease Amendment has been filed with the Bureau of Land Management. <br />Related Permit Actions <br />The B-Seam mine plan in the permit was approved by technical revision number 35. <br />Permit revision number 8 approved the initial development of the B-Seam. <br />Project Description <br />BRL has refined its B-Seam mine plan so it can mine a third panel, B 3, in the west. <br />The mine plan to the north has been changed to enhance resource recovery. The <br />Mains were moved from the west side to the east side of the panels because coal <br />quality deteriorates from east to west. The longwall panels will be developed from east <br />to west so development can be stopped based on coal quality. The mine plan does not <br />project mining under Terror Creek to the west. <br />The third lonwall panel, B 3, overlies the third panel in the D-Seam, WD-3. Subsidence <br />induced rockfall may affect Stevens Draw and Terror Creek in areas where no <br />structures are located. <br />Right of Entry <br />There a three issues regarding right of entry for this permit revision. The first is Federal <br />Coal Lease COC 61209 which provides right of entry for the majority of the mine plan <br />area. The second is pending approval of Lease Modification Number 2 to Federal Coal <br />Lease COC 61209. The third is the right to occupy the surtace over land owned by <br />Brian (William) Hughes. The agreement with Hughes is enclosed. <br />
