As you are aware, the <br />NW Sediment Trap was the subject of a vacated Notice of Violation, and a request for a <br />Declaratory Order from the Mined Land Reclamation Board. The justification for the request <br />centers around the admittedly cloudy issue of applicability of the Impoundment and Sediment <br />Pond performance standard regulations to this category of structures. Further, Sun Coal is <br />evaluating options for removal, reconstruction, and/or modification of the NW Sediment Trap, <br />as well as other water control structures at the mine site in light of their performance. A final <br />option has not been selected at this time, though engineering work continues. <br />Sun Coal appreciates the Division's cooperation in this matter.
