As you are aware, the
NW Sediment Trap was the subject of a vacated Notice of Violation, and a request for a
Declaratory Order from the Mined Land Reclamation Board. The justification for the request
centers around the admittedly cloudy issue of applicability of the Impoundment and Sediment
Pond performance standard regulations to this category of structures. Further, Sun Coal is
evaluating options for removal, reconstruction, and/or modification of the NW Sediment Trap,
as well as other water control structures at the mine site in light of their performance. A final
option has not been selected at this time, though engineering work continues.
Sun Coal appreciates the Division's cooperation in this matter. If you have any questions please call
me or Mike Savage. Thank you.
Sincerely,
~~~~~ ~-~
Bryan J.
