w DF~~T <br />Mii~ut2S, July 22-24, 1992 Subject To Board Approval 6 . <br />In response to Mr. Flynn's comme.its, Staff said that the Division is in <br />the process of reviewing the opere~tor's TR-10 submittal which includes <br />a proposal for installation an~i implementation c•f the INCO process. <br />Mr. Massey, on behalf of the operator, objected to the Board hearing <br />any testimony or accepting evidence related to the matter of TR-10 at <br />this time. He said this could cause a procedural problem when a <br />decision is made to approve or deny the technical revision and/or an <br />appeal is brought before the Board. <br />Mr. Frank Johnson clarified that ~.vhen a decision is made about TR-10, <br />all parties would have an opportunity to appeal the decision before the <br />Board. Therefore, he said th~a Board may prejudice the matter by <br />hearing any testimony regarding "-R-10 at this time. <br />Mr. Charlie Jacquez, a resident of the San Luis area, discussed a <br />concern about the tailings disposal area at the site. He said the area <br />in question is now being referred to as a dam, although it was not <br />built according to the specifications of a dam. Mr. Jacquez requested <br />that the Board require the operator to remove the tailings dam and its <br />contents to an area outside the Rito Seco drainage after mining has <br />been completed. He read a resolution from the Costilla County <br />Committee on Environmental Soundness regarding this matter and <br />presented it to the Board, along with a resolution from the Town of San <br />Luis (EXHIBIT D). <br />Mr. Alfredo Chavez, a San Luis resident and employee at the mine, <br />addressed the Board on behalf of the operator, its employees and some <br />of the residents of San Luis. He said that there have been no <br />discharges into the air or streams from the site, and he gave the Board <br />information related to economic and other benefits that residents have <br />incurred as a result of the operation of the mine in San Luis. It was <br />noted that several residents from the San Luis area were in attendance <br />during this hearing. <br />Ms. Maria Valdez, with the People's Alternative Energy Service, said <br />they want the Board to require the operator to adhere to the standards <br />set in the permit for cyanide levels, including active and inactive <br />ponds and the spigot. She further stated that they want the Board to <br />require the operator to provide weekly analysis, rather than monthly, <br />and that third-party monitoring be implemented as soon as possible. <br />Mr. Scott Mefford, a groundwater geologist representing the Costilla <br />County Conservancy District, recuested that they be provided with a <br />copy of the infiltration modelin~.I study conducted in the tailings pond <br />area (discussed during the June 1992 Board Meeting). He said this <br />study may be referenced during the Division's review of TR-08. The <br />Division verified that a copy of the study would be provided as <br />requested. <br />Ms. Jacquez requested that the Beard require the placement of copies of <br />inspection reports in the files maintained at the County Courthouse and <br />that full inspections be completed at the site on a quarterly basis. <br />
