This submittal was prepared in <br />response to the Division's March 14, 1991 decision to deny MR 15. <br />Peabody proposes to increase the size of topsoil stockpile N and add <br />54.5 acres of associated disturbance to the existing permit area. <br />Enclosed are three copies of the revised Operations Plan, Exhibit 12-I <br />(3-5-91) and 5 Year Permit Area Disturbance Map, Exhibit 12-2 (3-5- <br />91) which show the increased size of topsoil stockpile N and the 54.5 <br />acres of associated disturbance for advanced topsoil removal. <br />The disturbance represents a minor alteration in the sequencing of the <br />mine plan which will not cause a significant alteration in the <br />reclamation plan. Figure TR. 11-1, Operations Plan, was prepazed <br />and is enclosed to show the revised mine plan in the area of the <br />proposed disturbance. The 54.5 acres of disturbance is within the <br />permit boundary and life-of-mine disturbance area. <br />A map (Exhibit 7-13B3) which accurately shows the Pond 006 <br />watershed boundary and the proposed maximum disturbance area is <br />enclosed. Pond 006-Phase I was reevaluated to demonstrate the pond <br />has the required storage capacity to treat the runoff from a disturbance <br />area of at least 335 acres (see enclosed Appendix 7-8B). The increase <br />in maximum disturbance area from 277 acres (TR 10) to 335 acres in <br />the watershed will ensure that mining activities can continue until <br />Pond 006 is modified by Phase 2 construction. The as-built <br />certification of Pond 006-Phase I (Exhibit 7-13B1) is enclosed. <br />
