PROVIDED, HOWEVER, that if after five years of the recordation of this Deed <br />Grantee has not obtained all of the necessary annexation and zoning from the City of Golden, <br />issuance of an amended permit with [he Mined land Reclamation Board, and any required <br />environmental approvals (the "Mining Approvals") necessary to operate a quarry on the property <br />described in Exhibit 2, attached hereto and incorporated by reference, the property conveyed <br />herein shall automatically and without further action revert to the County. Grantee agrees that it <br />shall not encumber the property described in Exhibit I unless and until all of the Mining <br />Approvals have been obtained. <br />THE PROPERTY described in Exhibit l shall become encumbered by the Covenant of <br />Enhanced Mining and Reclamation Techniques recorded at Reception No. 1= /G o9 8{-3 in the <br />Jefferson County Clerk and Recorder's Office. <br />GRANTOR acknowledges and agrees that through its unvested reversionary interest <br />in the property conveyed herein Grantor does not have the authority, power, or obligation to <br />apply for, or be a signatory to, mining approvals for the property and that by this conveyance <br />Grantee receives such authority and power.
