<br />COMMISSIONER'S DEED ~
<br />THIS INDENTURE is madC this /571 day of UAW , 2002
<br />between the COUNTY OF JEFFERSON, STATE OF COLORADO, a body politic and
<br />corporate (the "County"), whose address is 100 Jefferson County Parkway, Golden, Colorado
<br />50419, acting by and through its duly constituted and appointed Chairman of the Board to
<br />quitclaim and execute this deed, and LAFARGE WEST, INC., a Delaware corporation
<br />("Grantee"), whose principal address is 12950 Worldgate Drive, Suite 500, Herndon, VA 20170.
<br />WITNESSETH
<br />THAT WHEREAS, the Board of County Commissioners of the County of Jefferson,
<br />State of Colorado, did at a regular meeting of said Board held at the Administrative/Judicial
<br />Facility in said County on the 1~` day of October, 2002, duly adopt and pass Resolution No.
<br />CC021+73 authorizing the quitclaim of the hereinafter described real property to the Gramee
<br />and did by said Resolution appoint and constitute [he undersigned as Commissioner to quitclaim
<br />and execute a deed for said real property to the Grantee for and on behalf of the County, and did
<br />further authorize the undersigned to execute this deed and to affix the seal of said County
<br />hereto.
<br />NOW, THEREFORE, FOR VALUABLE CONSIDERATION, in hand paid by the
<br />Grantee to the County, receipt of which is hereby confessed and ackrtowledged, the
<br />undersigned, acting as Commissioner aforesaid, does by these presents remise, release, sell, and
<br />quitclaim unto the Grantee, its successors and assigns, all the tight, title, interest, claim and
<br />demand which said County has in and to the real property situate, tying and being in the County
<br />of Jefferson, State of Colorado described in Exhibit L attached hereto and incorporated by
<br />reference.
<br />TOGETHER with all and singulaz the hereditaments and appurtenances thereto
<br />belonging, or in anywise appertaining, and the reversion and reversions, remainder and
<br />remainders, rents, issues and profits thereof, and all the estate, right, title, interest, claim and
<br />demand whatsoever of the County, either in law or equity, of, in and to the above bargained
<br />premises, with the hereditaments and appurtenances.
<br />AND TOGETHER with any buildings, fixtures and improvements thereon; and together
<br />with all rights, title and interest of the County in and to any alleys, strips or gores or vacated
<br />streets or alleys adjoining the above-described real property, all easements, rights of ways, and
<br />appurtenances thereto, and any permits, licenses or water or sewer taps relating to the real
<br />property; and together with all water and water tights, ditches and ditch rights, reservoirs and
<br />reservoir rights, stock in ditch and/or reservoir companies, wells and well tights, including
<br />tributary, nontributary and not nontributazy, whether adjudicated or not, on, under or appurtenant
<br />to or used on the real property.
