Kochman <br />10680 Utrillo <br />Northglenn, Colorado 802 3 <br />RE: Objection Letter, M $r M Mining Company, Snowstorm Placer, <br />Permit File No. M-8 084, Amendment No. AM-02 <br />Thank you for your letter of March 13, 1991 concerning the Snowstorm Placer. <br />Mr. Fred Banta asked me to address your concerns. <br />Your concern about final site topography may have been addressee in a previous <br />amendment. The original plans allowed for mining to occur in 12-acre tracts <br />over the entire 200-acre permit area. In addition, a north-south ridge on the <br />eastern edge of the property one mile long and with a 2H: TV west-facing slope <br />of 150' feet in length would have been left. Amendment No. AIA-O1, approved in <br />November, 1990, and the current amendment no longer have this ridge in the <br />final reclamation. M & hf Mining, while enlarging the permit area by 60 acres <br />to the north, has actually been approved for a excavation area of only 42 <br />acres, reducing the excavated area by 158 acres. M & M Mining is committed to <br />both concurrent.reclama~on and an active excavation area of only 2.1 acres. <br />In terms of areas east of Highe~ay 9 allowed for disturbance, M & M Mining is <br />currently approved to affect land in Section 19 and 30 of Township 9 South, <br />Range 77 West. This includes a .49 acre tract of Lana situated west of State <br />Highway No. 9 upon which the processing water pipeline from the South Platte <br />River is placed. M & M Mining is currently not approved nor applying to <br />affect any other property west of State Highway No. 9. <br />We believe the original reclanation plan is appropriate. It takes into <br />account topsoil replacement, revegetation and species selection, irrigation <br />and weed control based upon the elevation, precipitation and soil series found <br />at the site. <br />We understand fully your concerns about water quality. Statutes <br />34-32-116(7)(9), 7(h) and 7(i) of the Mined Land Reclamation Act requires <br />operators avoid actions that pollute surface or ground water, In addition, no <br />chemical processing is approved for the operation, however water may be used. <br />Operators are required, under Statute 34-32-709(5), to comply with all "other <br />applicable statues and rules and regulations." This would include laws and <br />rules enforced by agencies such as the Colorado Division of Water Resources <br />(for evaporative losses), the Colorado Department of Health (for water quality <br />discharge and fugitive dust control permits), and local governments.
