You a]so asked <br />whether. such a permitter could continue to mine and/or ship coal <br />after the date of permit, expiration until a final decision <br />regarding permit renewal ie made. Subsequently we discussed <br />whether a permittee could continue to mine after permit expira- <br />tion under the temporary relief provisions of the Regulations of <br />the Colorado Mined Land Reclamation Board for Coal Mining <br />(Regulations), 2 CCR 407-2, Section 2.07.4(4) if. the Division <br />issues a proposed decision regarding n renewal application prior <br />to permit expiration. After stating my understanding of the fac- <br />tual background for these issues, I will address them in turn. <br />Facts <br />Basin Resources (Basin) is the permittee of two coal permits <br />issued by the Division of Minerals and Geology (DMG or Division), <br />C-81-013 (Golden Eagle Mine), and C-81-012 (New Elk Mine).
