n <br />- Mr. Robert Sherman - 2 - December 15, 1989 <br />5. The road section of the permit application appears to be <br />incomplete. There are no designs for the haul road along Grassy <br />Creek nor the roads to Pits 1 and 2 and 3 per 4.03.1 (1)(d) or (e) <br />and 2.05.3(3)(c). I think it would be valuable for Rockcastle to <br />re-evaluate the classification scheme of the roads on the property <br />(i.e. haul roads, access roads and light use roads) and then ensure <br />that drainage and road designs are appropriately filed. <br />6. Evaluate the operation's policy on non-coal waste. At this time, <br />all non-coal waste is scheduled to be shipped offsite. A number of <br />culverts have been removed in the Pit 5 area over the last couple <br />of years. Rockcastle could permit a disposal area in Pit 4 per <br />Rules 4.11.4 and 2.05.3(8) if interested. <br />7. Revise the reclamation costs shown in Table 2 on page IV-4 to <br />reflect the bond set by the December 14, 1989, Board meeting per <br />2.05.4(2)(b). These costs should be refined to include the actual <br />cost of installation of the road rock buttresses and any costs <br />associated with drainage stabilization. <br />8. Prepare a list of water rights located within one mile of the <br />permit area and map them per Rule 2.05.6(3)(b)(v). <br />9. We have reviewed the permit application and the revision concerned <br />with leaving Ponds 3 and 5/6 as permanent impoundments. Please <br />adjust the reclamation plan to reflect the status of Impoundment 3 <br />on page IV-1. We do not see that the demonstrations listed in <br />4.05.9(1) were ever made. Please modify the permit application <br />accordingly. <br />10. Provide documentation that Rockcastle or the landowner has water <br />rights on impoundments at the site per Rule 4.05.6(5). <br />11. Please include the cross-sections for reclamation of the pond at <br />Pit 2 prepared by Rocky Mountain Surveyors on November 2, 1984 in <br />the permit application per 2.05.4(2)(c). <br />12. Prepare a grazing plan for the Grassy Gap Mine per the commitment <br />on page II-J-IIb of the permit. Include the carrying capacity of <br />the area (A.U.M.s), the number and type of animals to be grazed, <br />the percent utilization of the stand, and a schedule of rotation to <br />different areas. <br />13. Revise the rill and gully plan (page IV-15-a) to perform an annual <br />survey of the mine site and map those areas of instability by a <br />specific date each year. Commit to perform repair work by a <br />specific date. <br />14. Please revise the maps to .include legends which clearly identify <br />information thereon. <br />
