Cathy Begej <br />- 2 - October 3, 1989 <br />Later, on page 2.05.4-15, Kerr relates that these permanent stockpiles <br />" ., would be consistent with existing natural landforms ..." I am unable to <br />visualize these overburden stockpiles as conforming to approximate original <br />contour. Rather, these piles appear to produce peaks at least 125 feet above <br />the natural land surface, referring again to Map 38. These apparent peaks <br />do not conform to approximate original contour. <br />In summary, it appears that Kerr Coal Company does not demonstrate adequately <br />that the proposed piles or remaining highwalls con orm to AOC. They do admit, <br />on page 4.09-1, that any other plan is "economically infeasible". On a more <br />positive side, however, it appears that Kerr does address Rule 4.09 briefly in <br />4 1/2 pages. <br />/yjb <br />0178E <br />
