Knox <br />Division Etgineer <br />Purpose of this letter is to cotlfirm our phone conversation regarding administration of this pond is <br />accordance with the Doctrine of Poor Appropriation. <br />First, this structure is located in Maverick Draw, a highly over-appropriated atrz that requries <br />curtailment of vested water rights on an annual basis. <br />Second, absent a court app¢oved plan of augmentation, retention of natural runoff in the pond <br />during periods of river call will be bypassed or released from the pond in time and amount <br />necessary to satisfy senior vested water rights entitled to said natural runoff. This action will <br />require the owner of the reservoir to construct a bypass ditch around the pond or to pump <br />water directly from Ltte pond for ~vtter delivery back to Maverick Draw. <br />Third, as of this date, we are in receipt of a denied well permit application, #AD-13947 dated <br />September 6, 1996 for this structrure. <br />Sincerely, <br /> <br />Kenneth W.
