Adequacy questions previously resolved are not included in this letter. MCC will plan to leave the existing MB-4 sedimentation pond in place until the new pond has been constructed and is functional. 3. MCC is in the process of obtaining a letter from CDOT regarding the sizing of the culvert and acknowledgment of MCC's plans at the TLO. When this letter is received it will be forwarded to the Division. 4. Please find enclosed a copy of the amended CDPS permit that should be added to Exhibit 7 of MCC's permit. While the outflow from MB-4 will be relatively minor as compared to other discharges from the West Elk Mine, MCC will verify that the Probable Hydrologic Consequences section of the permit, submitted as TR#80, and still under review by the Division, includes the outflow. 6. The pond was not redesigned, only the emergency spillway, which does not effect the design of the pond. The discussion of the Stormwater Retention Pond in the design report was revised to include a discussion of the revised spillway system, and was enclosed with MCC's previous responses. A model to verify the design of the 12-inch pipe was referred to in MCC's previous response, but inadvertently left out of the package. It is now enclosed and should be included in Appendix C of the design report.
