Adequacy questions previously <br />resolved are not included in this letter. <br />MCC will plan to leave the existing MB-4 sedimentation pond in place until <br />the new pond has been constructed and is functional. <br />3. MCC is in the process of obtaining a letter from CDOT regarding the sizing of <br />the culvert and acknowledgment of MCC's plans at the TLO. When this letter <br />is received it will be forwarded to the Division. <br />4. Please find enclosed a copy of the amended CDPS permit that should be added <br />to Exhibit 7 of MCC's permit. <br />While the outflow from MB-4 will be relatively minor as compared to other <br />discharges from the West Elk Mine, MCC will verify that the Probable <br />Hydrologic Consequences section of the permit, submitted as TR#80, and still <br />under review by the Division, includes the outflow. <br />6. The pond was not redesigned, only the emergency spillway, which does not <br />effect the design of the pond. The discussion of the Stormwater Retention <br />Pond in the design report was revised to include a discussion of the revised <br />spillway system, and was enclosed with MCC's previous responses. A model <br />to verify the design of the 12-inch pipe was referred to in MCC's previous <br />response, but inadvertently left out of the package. It is now enclosed and <br />should be included in Appendix C of the design report. <br />
