GENERAL TERMS AND CONDITIONS: (IMPORTANTI READ ITEMS 6.7 AND 8) <br />1. This: permit is issued in reliance upon the accuracy end completeness of information supplied by the applicant and is <br />conditioned upon conduction of the activity, or construction, installation and operation of [ha source, in eccordanc.e with <br />this information and with representations made by the applicant or applicant's agents. I[ is valid only for [he equipment <br />end operations or activity specifically identified on the permit. <br />2. Unless specifically stated otherwise, the general and specific conditions contained in [his permit have been determined by <br />the APCD to be necessary to assure compliance with the provisions of Section 25-7-114, C.R.S. and, as such, shall be <br />enforceebl~: Under the provisions of Section 26-7-115, C.R.S., the Clean Air Act, 42 USC Section 7502(b1131; and Air <br />Duality Co.t[rol Commission Regulation No. 3 Section IV.D.2. or 121 result in an excaadance of Che NAADS for pollutants <br />es required by Sections 25-7-105(1)(A)(11 end 2011111b), C.q.S., of [he Clean Air Act; 42 USC Section 74751a)131: and Air <br />Quality Control Commission Regulation No. 3, Section IV.D.1 .c. <br />3. Each end wary condition of this permit is a material part hereof and is not saverahle. Any challenge to or eppetrl ol, e <br />condition hereof shell constitute a rejection of the entire permit end upon such occurrence, [his permit shall be deemed <br />denied ab inirio. This permit may ba revoked at any time prior to final approval by the Air Pollution Control Division (APCD) <br />on grounds set forth in the Colorado Air Duality Control Act and regulations of the Air Duality Control Commission (ADCCI~ <br />including t:rilure to meet any express term or condition of the permit. <br />4. This permit end any required attachments must be retained end made available for inspection upon request a[ [he location <br />set forth herein. With respect to a portable source which is moved [o a new location, a copy of the revised Air Pollutant <br />Emissions IJotice (APEN) (required by law to be submitted [o the APCD whenever a portable source is relocated) should be <br />attached to this permit. The permit may ba reissued to a new owner by the APCD as provided in ADCC Regulation No. 3 <br />Section III.f3. upon a request for transfer of ownership and the submittal of a revised APEN and the required (aa. <br />5. Issuance (initial approval) of an emission permit does no[ provide "final" authority for this activity or operation of this source. <br />Final approval of [he permit must be secured from the APCD in writing in accordance with the provisions of 25-7-114.5 <br />C.R.S. end ADCC Regulation No. 3, Section IV.H. Final approval cannot be granted until the operation or nctivity <br />commence; end has been verified by the APCD as conforming in all respects with the conditions of the permit. I( the APCD <br />so determines, it will provide written documentation of such linal approval, which does constitute 'final" authority to <br />operate. <br />6. THIS PERMIT AUTOMATICALLY EXPIRES IF you (11 do not commence construction or operation within 18 months <br />after either the data of issuance of [his permit or the date on which such construction or activity was scheduled to <br />commence es set forth in [he permit, whichever is later; (21 discontinue construction for a period of 18 months or <br />more; or 13) do not complete construction within a reasonable time Of the estimated completion date. Extensions of <br />the expiration date may be granted by the APCD upon a showing of good cause by the parmi[tee. <br />YOU MUST notify the APCD at least thirty days (fifteen days for portable sources) prior [o commencement of the <br />permitted ~>paration or activity. Failure to do so is a violation of Section 25-7-114.5(1211a), C.R.S. and ADCC <br />Regulation No. 3, Section IV.H.1 ., and can result in the revocation of the permit. <br />8. Section 25~7-1 1 41511a1, C.R.S. requires that all sources required to file en Air Pollution Emission Notice (APENI must <br />pay an annual fee to cover the costs of inspections end administration. If a source or activity is to be discontinued, <br />the owner must notify the Division in writing requesting a cancellation of the permit. Upon notification, annual fee <br />billing will terminate. <br />9. Violation of the terms of a permit which has received final approval or of the provisions of the Colorado Air Duality <br />Control Act or the regulations of the ADCC may result in administrative, civil or criminal enforcement actions under <br />Secdons 2ri-7-115 (enforcement), -121 (injunetionsl, -122 (civil penal[iesl.
