SECONDED. <br />During this time, Staff located the appropriate attachment for the <br />proposed order. The consensus of the Board was that the appropriate <br />documents had been located and would be attached to the proposed order. <br />The Motion and SECOND to table this matter were WITHDRAWN. <br />It was MOVED that the Board adopt the draft notice as the Notice of <br />Violation and Order, including the amendments, as announr:ed by Frank <br />Johnson, to Items 13, 20(b> and 21(c) and with the correct attachment <br />to be affixed to the document. SECONDED AND PASSED 3 for <br />(Kraeger-Rovey, Stewart and Cattany); 2 against (Jouflas aid Danni); 1 <br />abstention (Cooley); Danielson not present for the vote. cPlease refer <br />to the Board's previous Motion to amend the proposed notice of <br />violation--although it Failed, the amendments are the same as those <br />referred to as being announced by Frank Johnson and are specific to <br />this final Motion of the Board.) <br />Staff referenced a May 27, 1992 revised version of the list of <br />abatement requirements and provided an update, regarding tie status of <br />each of the items (12) it contained, as follows: 1) increase tailing <br />area security--implemented; 2) assessment of environmental <br />impact--satisfied; 3) acceleration of frequency of tailings area <br />environmental monitoring--implemented; 4) detoxification of <br />tailings--TR submitted on April 3 and approved on April 7, 1992 (CyTox <br />application continues); 5) development of collection pond leak <br />detection, etc.--satisfied; 6) cyanide detection, 'nterception, <br />etc.--made progress; 7) modification of ore processing methodology (45 <br />days after completion of detoxification)--satisfied by commitment; 8> <br />modification of tailings area reclamation (90 days after <br />detoxification)--satisfied by commitment; 9) modification of <br />environmental monitoring plan--made progress; 10) financial warranty <br />adjustment--satisfied; 11) development of project management <br />schedule--satisfied by commitment and 12) modification of water quality <br />monitor sampling and analysis protocol--progress made, with the <br />Division providing third-party monitoring at this point. Staff <br />answered questions from the Board. <br />The Board reconvened discussion of this Item on Thursday, May 28, <br />1992. Frank Johnson presented the draft order and said that the <br />changes discussed previously by the Board had been incorporated into <br />document. <br />It was MOVED that the Board adopt the Notice of Violation and Order, as <br />amended from the Board's May 27, 1992 discussion and as presented by <br />Frank Johnson. SECONDED AND PASSED 5 for (Kraeger-Rovey, Jouflas, <br />Stewart, Danni and Cattany); 1 abstention (Cooley); D•anlelson not <br />present for the vote. <br />
