ti <br />Edna Strip Mine, Bond Release No. SL-8: pace 2 <br />No written objections or requests for informal conferences <br />regarding the proposed bond release were received by DMG. <br />DMG received one phone call inquiry from the Routt County <br />Planning Department confirming that the former office building <br />next to Oak Creek is not part of this current bond release <br />application. This inquiry is noted in DMG's proposed decision. <br />On January 20, 2004, DMG received a letter from the Routt County <br />Planning Department regarding the approved post mining land use <br />of commercial-industrial for the 3.3 acre gravel pad/entrance <br />gate portion of the bond release request. As a result of this <br />letter, DMG withdrew the December 19, 2003, Proposed Decision and <br />notified OSM of this action. OSM had already mailed a concurrence <br />letter to DMG, agreeing with the December 19, 2003, Proposed <br />Decision. _ _ <br />The only change in this February 13, 2004, DMG Proposed Decision <br />compared to the December 19, 2003, submittal, is that the bond <br />release request for the 3.3 acre gravel pad/entrance gate area is <br />now limited to Phase I liability release for the removal of <br />structures on this 3.3 acre area, the remaining Phase I, II and <br />III reclamation liability remain for the 3.3 acre area. DMG <br />received a revised bond release application from the operator <br />requesting the release of $996,722 for 13.3 acres. This amount <br />was subsequently revised to request a release of $767,923 for <br />13.3 acres. <br />DMG's proposed decision thoroughly recounts the Edna Strip Mine <br />reclamation history and previous bond release actions. The <br />completion of reclamation requirements for the proposed release <br />area including DMG approved retention of the Goat Trail road and <br />ditches, and power line, are well documented in DMG's proposed <br />decision. <br />Backfilling and grading, topsoil replacement, sediment yield, and <br />revegetation success findings for the proposed release area are <br />included in DMG's proposed decision. The proposed bond and <br />reclamation liability amount remaining after the bond release is <br />$3,071,961 and is sufficient for a third party to cover the costs <br />of remaining reclamation requirements, which are primarily <br />successful vegetation reestablishment, and required environmental <br />monitoring. <br />
