Cattany, Division Director <br />Division of Minerals & Geology <br />Colorado Department of Natural Resources <br />1313 Sherman St., Room 215 <br />Denver, Colorado 80203 <br />MAR 2 2 ?.G~4 <br />Division ~f Minerals and Geology <br />Re: Proposed Decision to Approve Phase I, II, & III Bond Release, <br />Edna Strip Mine, Permit No. C-80-001, Bond Release Application <br />No.8 (SL-8). <br />Dear Mr. Cattany: <br />This letter acknowledges the Office of Surface Mining's (GSM's) <br />receipt and review of the Colorado Division of Minerals and <br />Geology's (DMG) February 13, 2004, Proposed Decision for <br />full Phase I, II, & III bond and liability release on the <br />Edna Strip Mine reclaimed areas defined in the above application <br />that includes Federal lands. OSM is in agreement with the <br />Proposed Decision and hereby provides OSM concurrence to release <br />Phase I, II, & III bond and liability as documented below in <br />accordance with, the Federal Regulations at 30 CFR..740.15,(d)(3), <br />and 30 CFR 906.30.24, Article VIII of the State-Federal. <br />Cooperative Agreement. <br />The DMG conducted the bond release inspection required at <br />Colorado Rule 3.03.2(2) on October 8, 2003. DMG's Proposed <br />Decision documents the inspection findings and indicates that all <br />required public notices, and surface and mineral owner <br />notifications were made in a timely manner prior to the <br />inspection. The CSM Denver Field Division (DFD) did not <br />participate in the bond release inspection, but DFD evaluated the <br />proposed bond release area during a joint, complete, oversight <br />inspection of the mine conducted with DMG on September 23, 2003. <br />The U.S. Department of the Interior, Bureau of Land Management <br />(BUM) was notified of the inspection but elected not to <br />participate. DFD has received BLM's concurrence letter ,dated <br />February 20, 2004 (attached). No other Federal land management <br />agencies are. involved in this action. <br />~NAMERICA~ <br />
