Rule 2.04 Environmental Resources: <br />Division Concern: <br />1. On pages 2.04-4-2 and 2.04.4-6, it is stated that the archeological <br />report on the rail spur has been submitted to the Division. However, <br />the Division cannot find a copy of this report in our records. The <br />operator should submit one copy of this report. <br />Response- <br />~ A copy of the rail spur archeological report will be submitted with <br />~ these comments. <br />Division Concern: <br />2. A page marked "confidential" should be numbered 2.04.6-7 and inserted <br />into the permit. <br />Response- <br />As requested, the "Confidential" page numbered 2.04.6-7 is attached <br />and should be inserted into the appropriate location in the <br />Ow application. <br />Division Concern: <br />3. In sections 2.04.6-8 and 4.14.1, the permit discusses overburden swell <br />factors. It was noted in the review that the original permit estimated <br />swell at 17%, the new permit estimates swell at 20%, and the current <br />monitoring data indicates a swell of 18%. Based on these figures, the <br />postmining topography may vary by as much as + 11 feet. Colowyo <br />should therefore insert (on page 4.14.1-2) a short discussion on how <br />this possible variation would effect achievement of the designed <br />topography, including what operational modifications might be <br />necessary should the monitoring program detect a discrepancy. Of <br />particular concern is the reestablishment of drainage channel <br />gradients. <br />Response <br />Section 4.14-1 has been revised to address the Division's concern <br />o~ (revised pages attached). <br />-2- <br />
