EFCI's proposal to leave the west collection ditch as a permanent diversion is <br />acceptable. However, please clarify how this channel will br rerouted once the <br />sediment pond and norther refuse collection ditch are removed. Permanent <br />dizersion 1 will continue to be the upland diversion for the refuuse pile. <br />Response: The end of the west refuse ditch will be terminated in the same fashion as the <br />clean water diversion. The north and south ends of the west ditch will be tapered into the <br />existing topography so that the runoff is dissipated into sheet flow. Riprap (D50=6") will <br />be placed at both outlets of the ditch to help dissipate the flow. The clean water diversion, <br />which handles significantly higher flows, has been in place for over 10 years and has received <br />runoff from storm events greater than the 10-year, 24hour event. Since construction of <br />the clean water diversion the outlet has shown no signs of significant erosion. <br />11. EFCI should provide documentation in which the Atchison, Topeka, and Santa Fe <br />Railroad (ATSFRJ and .9damic request that the eastern loadorrt remain in iu current <br />conf:grrration or as close as possible to its current configuration. Also, please provide <br />documentation in which the ATSFR states that the railroad tracks will remain in place. <br />Unfortunately, AOC cannot be ignored simply because the landowner regtuesu it. /f the <br />railroad tracks will remain, then the Division will reconsider orur previous position of <br />requiring EFCI to reestablish the ridge. However, EFCI will at least need to replace the <br />material removed from the lower northwest end of the east loadout. The Division was <br />unable to locate pre-permitting aerial photos orpre-mine topography maps of the loadout. <br />Please provide this infornmtion to verify the extent of the disrrrrbance of the loadout prior <br />to perrnizting of the Sotrrh. field Mine. /n addition, please provide information as to when <br />the foadorrt was consrrrrcted for the Southfield .4fine. <br />EFCI's permit on page 2.OS.S-1 states that Fremont Corrnry has zoned the loadout area <br />under an agricrrltrrral zoning designation, and not an indrrstrral designation. If this has <br />changed, the permit should be revised. <br />Cross-sections of the loadorrt are trot shown on ltifup 30, nor was a revised map included <br />as indicated in the April 29 responses. £FCI may also consider changing the numbrr of <br />the map as 14/ap 30 is currently irr the permit as the Sorudi ,bfine Fun Installation. Alease <br />provide the cross-sections. <br />Response: The railroad tracks were in place by the early 1900s. The existing railroad tracks <br />were access to several mines south of the loadout and are the property and responsibility of <br />the ATSFR.
