5. The reclamation deadline will pass before the Board's
December meeting.
6. NCEC came before the Board on October 17, 1990, two days
before the Division issued its proposed decision, on a
petition for a declaratory order and asked the Board to
issue a declaratory order to reverse an aspect of the
Division's proposed decision. The Board continued the
petition for a declaratory order to the November Board
meeting.

THEREFORE, the parties request the Board to issue an order:
Continuing the hearing to the December 1990 Board meeting
and consolidating it with the hearing on the petition for a
declaratory order;
Requiring all interested parties to file a request for
party status by November 23, 1990;
Requiring all parties to file a statement of the issues
they want the Board to consider by November 30, 1990;
Setting December 5, 1990 as the deadline for filing any
written briefs on the issues to be considered at the hear-
ing;
Setting a pre-hearing conference to be held at the
Division's office at 1 p.m. on December 7, 1990;
Designating a Board member to act as the pre-hearing con-
ference officer in this matter; and
Vacating the December 10, 1990 deadline for the performance
of reclamation pending the outcome of this appeal.
