NCEC came before the Board on October 17, 1990, two days <br />before the Division issued its proposed decision, on a <br />petition for a declaratory order and asked the Board to <br />issue a declaratory order to reverse an aspect of the <br />Division's proposed decision. The Board continued the <br />petition for a declaratory order to the November Board <br />meeting. <br />7 <br />8. <br />9. <br />10 <br />11 <br />12 <br />13. <br />THEREFORE, the parties request the Board to issue an order: <br />Continuing the hearing to the December 1990 Board meeting <br />and consolidating it with the hearing on the petition for a <br />declaratory order; <br />Requiring all interested parties to file a request for <br />party status by November 23, 1990; <br />Requiring all parties to file a statement of the issues <br />they want the Board to consider by November 30, 1990; <br />Setting December 5, 1990 as the deadline for filing any <br />written briefs on the issues to be considered at the hear- <br />ing; <br />Setting a pre-hearing conference to be held at the <br />Division's office at 1 p.m. on December 7, 1990; <br />Designating a Board member to act as the pre-hearing con- <br />ference officer in this matter; and <br />Vacating the December 10, 1990 deadline for the performance <br />of reclamation pending the outcome of this appeal. <br />-2- <br />
